Lawsuit against publisher over retraction comes a step closer to reality

De GruyterAn author has begun the process of taking legal action against a publisher for retracting his paper.

As we reported last month, John Bishop, the CEO of an independent media company called Crocels, based in Pontypridd, Wales, argues that by taking down his paper, De Gruyter defamed him and breached a contract — their agreement to publish his paper. Now, Bishop has sent the publisher what’s known in the UK as a “letter of claim.”

In the letter, Bishop writes:

Two math papers are too similar, both retracted

Advances in Differential EquationsA mathematician has lost two publications that overlap substantially.

In this case, it’s easy to see how editors were duped (as it were). Both journals received the papers within a few months of each other, and then published them in quick succession; both have since been retracted. The papers share a first author, Jin Li, affiliated with Jiujiang University in China.

JACS corrects, removes author from previously flagged paper

JACSA paper at the center of a high-profile case of alleged misconduct in Hong Kong has earned a correction notice.

The correction replaces an expression of concern on the Journal of the American Chemical Society (JACS) paper, which followed allegations of data manipulation. It provides some un-cropped images, and removes a co-author from the paper. However, it does not appear to address previous allegations of misconduct, nor a recent ruling from an investigation at Hong Kong University (HKU), which found that some of the data were “invalid.”

Author threatens to sue Elsevier if paper remains retracted

An author is prepared to sue Elsevier if it doesn’t un-retract his paper.

Computational Materials Science published two papers by the same author just eight months apart; nearly four years later, the journal pulled one for duplication. Author Masoud Panjepour, affiliated with Isfahan University of Technology in Iran, told us that he is working with a lawyer to negotiate a solution. However, if the publisher does not un-retract the paper, he does “not rule out filing a lawsuit.”

Paper plagiarizes from handwritten manuscript

semiform groupThis case of plagiarism is a little weirder than usual.

A paper has been retracted from Semigroup Forum because it includes material taken from another researcher’s manuscript — which was handwritten. In fact, the same journal had already published a paper by the plagiarized researcher, also based on the same manuscript. The journal editor told us that, although the two papers are similar, they are not word-for-word copies, and thus escaped detection.

Doing the right thing: Authors share data, retract when colleague finds error

A pair of chemical engineers has retracted a paper after another researcher was unable to replicate their work, in a case that we consider an example of doing the right thing.

Dennis Prieve, at Carnegie Mellon University, was interested in applying the paper — on how systems of molecules known as “reverse micelles” conduct electrical charge — to his own work, but was having trouble repeating the calculations. So Prieve contacted the authors — John Berg and his PhD student Edward Michor, based at the University of Washington — who supplied him with their original data.

It took several weeks of back and forth to figure out the problem, Michor told us, as the paper was published in 2012, so he had to decipher his old notes. When they found that several incorrect values were used in the paper, the authors issued a retraction notice, published in March:

Dairy journal retracts paper lacking co-authors’ consent

Dairy science and technologyA journal about dairy science has retracted a paper after learning that it was published without the consent of all its authors.

An independent inquiry found no evidence of research misconduct, but nevertheless recommended that the institution — Curtin University in Perth, Australia — request to retract the paper.

Oops — journal published same paper three times

surface interface analysisOn November 25, 2014, a journal published an article on mass spectrometry. Then on December 18th they published it again — twice.

Yes: “Mass analysis by Ar-GCIB-dynamic SIMS for organic materials” was mistakenly published a total of three times.

Over a year later, the journal pulled the two redundant publications. Here’s the retraction notice for one of them:

Authors suspended as duplications sink papers on ship building

A pair of researchers affiliated with the University of Galati in Romania were suspended after duplicating work in their papers on materials used to build ships, earning them four retractions last year, and one the year before.

According to Romanian newspaper Impact Est, in December an ethics committee found that co-authors Ionel Chirica and Elena-Felicia Beznea committed “a number of breaches of ethics,” including self-plagiarism. Both received two-year suspensions from holding certain research positions.

These aren’t the only problems Chirica has faced: In 2013, he resigned from his position as the director of the Doctoral School of Engineering, according to Impact Est, for reasons that are unclear. In 2012, he also lost two additional papers on which he is the sole author.

Last fall, Computational Materials Science retracted four papers by Chirica and Beznea, publishing almost identical notices. We’ll start with the one for “Response of ship hull laminated plates to close proximity blast loads:”
