BMJ journal yanks paper on cancer screening in India for fear of legal action

BMJ Global Health has pulled a paper that criticized U.S. research of the effects of cervical cancer screening in India over defamation concerns.

That’s not what the notice on the paper says, however — at the moment, it just reads:

This article has been withdrawn.

However, forwarded email correspondence between the first author and an associate publisher reveals the journal published the paper and planned a press release, then realized it should be reviewed by a legal adviser. When first author Eric J. Suba at Kaiser Permanente San Francisco Medical Center inquired about the status of the paper and any potential press release, he was told the journal could no longer publish it, out of concern they would be taken to court.

Would-be Johns Hopkins whistleblower loses appeal in case involving Nature retraction

A former researcher at Johns Hopkins who voiced concerns about a now-retracted paper in Nature has lost another bid for whistleblower protection.

Daniel Yuan, a longtime statistician for former Hopkins yeast geneticist Jef Boeke, was dismissed in 2011, after he’d spent years raising concerns about research coming out of the lab. Yuan’s criticisms, which continued after he stopped working for Boeke, peaked in 2012 after Boeke and former labmate Yu-li Lin published a paper in Nature. Later that year, Lin was found dead in his lab, a suspected suicide. In 2013, the paper was retracted, citing an inability to reproduce the main conclusions. 

Since 2013, Yuan has pursued a wrongful termination lawsuit, claiming that federal regulations surrounding scientific misconduct afforded him protection from retaliation.

In late March, Maryland’s highest court ruled against Yuan, saying that those misconduct regulations are “too vague” to offer cover to employees claiming whistleblower protection. According to lawyers we consulted, the decision could make it harder for would-be whistleblowers to fight retaliation, while also giving institutions more leeway to handle these issues on their own.

Publisher blames bad choice of reviewer for publication of hoax paper on penis as “social construct” 

Less than a week after publishing a much-discussed hoax paper, a scholarly publisher has acknowledged that it had chosen reviewers for the paper whose “expertise did not fully align with this subject matter.”

The subject matter: that the penis should not be considered an anatomical organ, but more as a concept – “a gender-performative, highly fluid social construct.” Upon publication, the authors immediately admitted the paper was a prank, arguing that its publication illustrates a lack of intellectual and scientific rigor in some social sciences, especially gender studies. But others have questioned whether it really demonstrates that at all.

Reuters removes story on gender confirmation surgery because firm mistakenly released data

Reuters has removed a story about gender confirmation surgery, saying it included problematic data.

The public relations firm representing the American Society of Plastic Surgeons (ASPS) — which generated the data in the report  — took responsibility, saying it supplied Reuters with data the ASPS did not want released.

Yesterday, Reuters pulled its version of a widely-reported story about an increase in such surgeries in the U.S. (Later, it pulled the withdrawal notice as well, only to make it reappear at a different URL.)

The story, originally posted just after midnight yesterday, reported a 19 percent increase in those procedures from 2015 to 2016, based on data provided the American Society of Plastic Surgeons (ASPS). Around 1 pm US Eastern time that day, Reuters put up a withdrawal notice in place of the original story:

Ex-PhD candidate sues advisor, school: Colorado prof “poisoned the well” after research dispute

A former University of Colorado Boulder graduate student is suing his ex-advisor for defamation after being shooed out midway through his doctoral program.

Robert Roscow says he had to leave CU Boulder’s department of Ecology and Evolutionary Biology (EBIO) in the fall of 2016 with only a master’s degree after fish evolution researcher David Stock dropped him as a student. Their relationship deteriorated following a dispute about whether another student should perform experiments Roscow considered to be essential to his dissertation.

Once dropped, Roscow was offered the chance to find another advisor, but never did. In his complaint, filed April 25 in Boulder County District Court, Roscow claims he has evidence that Stock “poisoned the well” by badmouthing him in email and in person to other professors, ultimately preventing Roscow from completing his degree.

As first reported by BusinessDen, Roscow is also suing CU Boulder for a breach of contract and for failing to “provide [him] with the reasonable opportunity to pursue his PhD,” among other allegations. 

CU Boulder declined to elaborate on the case. Chief Spokesperson Ryan Huff told us:

Journal retracts paper eight months after U.S. Feds announce findings of misconduct

In August, the U.S. Office of Research Integrity announced that a former postdoctoral fellow at the National Human Genome Research Institute (NHGRI) doctored data in two published papers.

It took one journal a little longer than five months to remove the researcher’s name from the co-author list, and replace one figure.

It took the second journal more than eight months to retract the paper.

Journal: Here’s why we didn’t retract this duplicated paper

Here’s something we don’t see every day: A journal explains in an erratum notice why it chose not to retract a paper that contains data published elsewhere.

According to the Journal of Business and Psychology, the authors violated the journal’s transparency policy by failing to disclose that they’d used the same data in their 2014 in three others. However, the editors ultimately concluded the current paper was different enough from the other three to save it from being retracted.

“Dramatic impact:” Authors misread breast cancer treatment database, retract paper

A journal has retracted a 2016 study on the use of radiation by breast cancer patients after the authors misinterpreted what was reported in a national cancer database.

Correcting for the error, according to the retraction notice, had a “dramatic impact on the original article data and conclusions.”

Quyen Chu, a surgeon at Louisiana State University Health Shreveport, told us that the problem appears to stem from a misunderstanding about the US National Cancer Database (NCDB). After the paper was published, the NCDB pointed out to Chu that a key data point had not been reliably or consistently collected during the timeframe relevant to the study. The database’s user’s manual says essentially the same thing; Chu said he and his authors read it, but misunderstood it.

The original Journal of the American College of Surgeons study looked at whether a 2004 National Comprehensive Cancer Network treatment guideline — which suggested some patients could avoid radiation on top of surgery and hormone therapy — led to an actual decrease in radiation therapy. But the error forced the authors to drop tens of thousands of patients treated before 2004, which had a severe impact on their ability to draw conclusions.

Paper by Harvard cancer biologist flagged over “credible concerns”

A cancer biologist at Harvard who’s issued multiple editorial notices in recent years has received an expression of concern about a 2011 paper, citing “credible concerns” with the data and conclusions.

The publisher does not detail the nature of the issues in the notice.

In the past few years, last author Sam W. Lee lost a Molecular Cell paper in 2013 due to figure duplication and a Journal of Biological Chemistry paper in 2015, citing “manipulated” data in a figure.

Lee also issued two mega-corrections in 2011 in Nature and Current Biology, which also cited figure duplication. Interestingly, both papers were corrected for a second time — the 2006 Current Biology paper in 2016, over figure-related errors, and the 2011 Nature paper in 2015, over concerns the animals used may have experienced excess suffering (prompting an editorial from the journal).

Despite author’s protest, journal removes paper on emergency department prices

A journal has temporarily removed a paper showing the dramatic differences in the cost of providing emergency care that caught national attention (and some criticism from emergency care providers), despite the first author’s claims that the results are valid.

The paper, published online in February by the Annals of Emergency Medicine, showed that it can cost significantly more for patients to be treated at emergency departments than at urgent care centers, even for the same conditions. Soon after the paper was published, first author Vivian Ho at Rice University was told by the American College of Emergency Physicians, which publishes the journal, that there were some errors in the appendix, and they wanted to reanalyze the entire paper.
